Understanding New ITC Compliance Changes and Challenges

The Center for Impact Finance from the Carsey School of Public Policy at UNH brings you this two-part webinar. The first session will dive into the new federal rules that determine how projects comply with new “Prohibited Foreign Entity” (a/k/a FEOC) rules to qualify for the new Investment Tax Credit (ITC). Although compliance for specific projects is beyond the scope of this webinar, our aim is to give participants a working understanding of the fundamental mechanics of the Prohibited Foreign Entity rules, how to identify primary questions and concerns for their projects, and be active, informed partners with accounting and legal advisors to comply with the new regulations and monetize tax credits.  As mentioned above, session on August 13, 2025, at 2:00 p.m. ET will cover Prohibited Foreign Entity (aka “”PHE” or “FEOC”) rules. Webinar #2, to be held later in August/ early September, will look at recent changes in the IRS’ “begin construction” analysis central to determining whether PHE applies and under what conditions a given solar project is eligible for the ITC. The webinars will be led by Rebecca Rogers, a partner on the Energy & Climate Team at Foley Hoag, LLP, and a longtime UNH friend. Rebecca provides full suite legal services – from M&A and development contracting to all aspects of project finance -- to for-profit and nonprofit sponsors, financial institutions and investors building renewable energy projects across the country.
